LEGAL BASES OF PARTICIPATION IN THE SWEEPSTAKES
1. Company organizing the promotion
The company
Diana Gazzaneo Arias
domiciled in Calle Juan Pérez Delgado Nijota, Santa Cruz de Tenerife, and identified with the number 42,243,590-L organizes the draw WIN 5 NIGHTS FOR 2 PEOPLE (hereinafter referred to as “the Promotion”) at national and international level, to be developed over the Internet, exclusively for users residing in Europe in accordance with the provisions of the section participation requirements.
The purpose of this draw is to gain followers on the social networks of DIANASUPERHOST accounts
2. Start date and end date
The Promotion will begin on February 19, 2021, and will end on March 13 at 23:59h.
3. Participation and mechanical requirements for promotion
The participation requirements shall be as follows:
– Persons residing in Europe who are over 18 years of age may participate.
– Only those who are holders of an Account on Instagram will be able to participate.
– Participants shall:
- Follow the @dianasuperhost.
- LIKE the post.
- Comment on the post by tagging one (1) person.
- Share the post in your stories (if it’s a private account they’ll need to send a screenshot).
– Participants will only be able to participate with a single Instagram profile. If a Participant is found to be participating with multiple Instagram profiles, they will be disqualified.
– Even if Participants write multiple comments in the same post, they will only participate with a single entry in the random draw, unless it is tagging different persons.
– The app will accumulate mentions and hashtags from the same Participant even if they are in different comments.
4. Promotion terms and prizes
The winner will be chosen randomly. The winner will be [14/03/2021] communicated through the social profiles of the brand, along with the certificate of validity of the draw.
The prize will consist of accommodation (on a 5-night accommodation only) for 2 people in one of our two one-bedroom holiday accommodation with registration number VVA-38-4-0009549 and VVA-38-4-0009548 in Puerto de la Cruz, Tenerife. The prize may be redeemed between 15/03/2021 and 30/09/2021 to be agreed and subject to availability of dates. The winner must pay a deposit of 200 euros that must be delivered at the time of accommodation and will be refunded once the apartment is delivered and the good condition of the apartment is verified. The prize may not be redeemed for cash or any other prize, nor may it be exchanged or altered. The Winner agrees to post by @dianasuperhost the accommodation for advertising purposes.
The completion of the draw will be conditioned on the participation of 500 users of the Instagram social network and provided that they comply with the Participation Requirements set out in point 3.
The holding of the draw, as well as the award of the prize are subject to the current tax regulations
5. Disqualifications and penalties
If it is found that any of the Entrants do not meet the requirements of the Databases, or the data provided to participate are not valid, their participation will be deemed void and they will be automatically excluded from the Promotion by losing all rights in the prizes awarded under this Promotion.
6. Posting comments or opinions
Comments or opinions deemed inappropriate, offensive, insulting or discriminatory or that could violate the rights of third parties will not be permitted. Nor will comments be allowed against an individual who violates the principles of the right to honour, personal and family intimacy and self-image. We will not be liable for any damages caused by feedback made by Participants in the Promotion, and that at any time may hurt the sensitivity of other Participants.
Participation in this Promotion, as well as the posting of comments made by Participants in the posts may not violate under any circumstances the Instagram Community Rules or the Instagram Terms of Use.
7. Disclaimer
By way of example, but not limited to, we are not responsible for any loss, theft, delay or any other circumstance attributable to third parties that may affect the development of this Promotion, nor are we responsible for the Participant’s use of the prize it obtains from this Promotion.
We do not assume responsibility in cases of force majeure or fortuitous case that could prevent the realization of the Promotion or the total or partial enjoyment of the prize.
8. Protection of personal data
In accordance with the provisions of the General Data Protection Regulation, each participant with the acceptance of these Legal Bases consents to their personal data being incorporated into a file, owned by it, in order to manage the draw, as well as disseminate and publicize its results, and process the delivery of the prize.
We inform you that you can exercise your rights of Access, Rectification, Suppression, Opposition, Limitation of Processing, Portability, forgetfulness and not be subject to automated individual decisions by sending an e-mail to info@dianasuperhost.com,copy of an identification document.
9. Changes and acceptance
We reserve the right to modify or extend these promotional terms, to the extent that it does not harm or undermine the rights of The Promotion Participants.
The mere fact of participating in the sweepstakes implies that the Participant fully accepts the terms of these Legal Bases. Likewise, participation in a sweepstakes of this nature implies acceptance of the rules of the Social Network Instagram through which it is developed.
10. Applicable Law and Jurisdiction
These legal bases shall be governed by the law of Spain. The Courts and Tribunals of the City of Residence of the Participants shall have jurisdiction to resolve any claim or dispute that may arise in connection with the validity, interpretation or enforcement of these Terms and Tribunals.
